Let’s be real for a second…

No one wants to talk about death. It feels heavy, morbid, and a little too real. Most of us would rather scroll TikTok, binge Netflix, or pretend we’ll live forever than sit down and think about wills.

But here’s the thing — I’ve seen firsthand in my legal practice what happens when people don’t. And trust me, the fallout can be messy, expensive, and heartbreaking. Families end up fighting, ex-partners suddenly pop back into the picture, and kids’ futures land in the hands of courts instead of the people you’d actually want raising them.

Not exactly the legacy anyone wants to leave.

So let’s bust some myths, shall we?

Myth #1: I’m too young for a will.

Here’s the truth bomb: tragedy doesn’t check your birth certificate.

In Australia, anyone over 18 can (and honestly, should) make a will. Think about it — if you’ve got a car, a phone, some superannuation, or even just a little money in your bank account, what happens to it if you die without a will? Spoiler: the law decides, not you.

Myth #2: I don’t have enough stuff to bother.

This one kills me (pun intended). You might think you’re “asset poor,” but when you add up your super balance, your car, personal belongings, maybe even some shares or crypto — it’s probably more than you realise.

And don’t forget digital assets: photos, social media, accounts. Without a will, your loved ones may struggle to even access these.

Myth #3: Everything automatically goes to my spouse and kids.

Not so fast. In Australia, if you die without a will (that’s called intestate), the law decides who gets what. And the law’s choices don’t always line up with yours.

Your spouse might not get everything. De facto relationships can get complicated. And if you’re single, your assets could end up with relatives you haven’t spoken to in years. Yikes.

Myth #4: Wills are expensive and complicated.

Sure, a professionally drafted will costs a few hundred (sometimes a bit more if things are complex). But compared to the tens of thousands your family might spend in legal fees without one? It’s a bargain. Think of it like insurance: pay a little now to save a whole lot later.

Myth #5: I can just DIY it.

Technically, yes. But I’ve seen too many DIY wills go horribly wrong — unclear wording, missing witnesses, or simply not covering all scenarios. Guess what happens then? Court disputes. Family drama. Stress your loved ones don’t need.

Put simply: don’t ChatGPT your will. Get it done properly.

So what’s a will really about?

It’s not about being morbid. It’s about love, care, and responsibility.

A will covers who gets your assets, who carries out your wishes, who looks after your kids if they’re under 18, and even your funeral preferences. It’s your final act of clarity and kindness for the people you leave behind.

Take action now (your family will thank you).

If you’ve been putting this off, here’s your sign to stop procrastinating. Think about what you own, who you’d want to benefit, and then talk to a lawyer who specialises in wills and estates.

Yes, it’s awkward. Yes, it costs a bit. But the peace of mind? Absolutely priceless.
